Currently, if neither previous employers nor their insurer can be traced, asbestos victims cannot obtain rightful compensation through the courts. The Mesothelioma Bill seeks in part to redress this appalling injustice by making compensation available to asbestos victims who are unable to pursue a civil claim through the courts.
However as it stands, the Mesothelioma Bill:
- excludes asbestos victims diagnosed with asbestosis, pleural thickening or asbestos related lung cancer
- has a cut off and will only pay mesothelioma victims diagnosed after 25th July 2012
- only pays 70% of average compensation
The 100% Justice campaign calls for the cut off date to be changed and for 100% compensation to be paid to mesothelioma victims who, diagnosed with this insidious disease, have already paid enough with their lives.
